Page 1 (ut Soo /ks a 4a, ORDINANCE No. 952 An Ordinance to Adopt a Housing Code to Prescribe Regulations for thé Sanitary Conditions of Which any Habitable Occupancy Must Provide for safe and Healthful Living in the Corporate Limits and Police Jurisdiction of the City of Prichard, Providing For the Enforcement of Said Regulations, and Prescribing penalities for the violation thereof. . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS FOLLOWS: SECTION 1. Pursuant to the authority granted to the Cities and Towns of Alabama by Title 37, Sections 491 and 492, of the Code of Alabama, 1940, as amended, there is hereby adopted by the City Council of the City of Prichard, Alabama, for the purpose of prescribing uniform rules and regulations governing the Public health and safety, all that certain code printed inpamphlet form known as Southern Standard Building Code, Part IV, Housing, being particularly the 1960-1961 edition thereof and the whole thereof, of which code not less than Three (3) copies have been and now are filed in the office of the City Clerk of the City of Prichard, Alabéna, and the same is hereby adopted and incorporated as fully as if set out in length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling in the construction, maintenance, alteration, or repair, of all buildings and structures within the corporate limits and police jurisdiction of the City of Prichard, Alabama. SECTION 2, The code hereby adopted is adopted for the purpose of prescribing regulations for the public safety, health and general welfare, and safety to life and property. SECTION 3. Penalities. Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any notice or order made thereon, shall severally, for each and every violation and non-compliance respectively, be guilty of punishable an offense against the City of Prichard,by a fine not exceeding Page 2 Page 2. $100.00 or by imprisonment for not more than six (6) months, or by both such fine and imprisonment. The imposition of one penalty for violation shall not excuse the violation or permit it to continue. The application of the penalty shall not be held to prevent enforced removal of prohibited con- ditions. SECTION 4, All former ordinances or parts thereof conflicting or inconsistent with provisions of this ordinance or of the code hereby adopted are hereby repealed. SECTION 5. Should any section, paragraph, sentence, or word of this ordinance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this ordinance and the code hereby adopted independent of the elimination therefrom of any such portion that may be declared invalid. SECTION 6. This ordinance and the code hereby adopted shall take effect and be in force immediately upon its adoption and publication as required by law. Adopted this the 23rd day of May, 1963.
