Page 1 CRDINANCE NO. 973 én Ordinance to adopt a Building, Plumbing, sas, Electrical, and Housing Code prescribing regulations governing the construction, erection, alteration, or improvement of buildings, the installation of plumbing or Dlumbing Zixtures, the installation of gas or gas fixtures, the installation of electrical wiring and apparatus, and for the sanitary conditions which any habitable occupaney must provide for safe and healthful living in the corporate limits and police jurisdiction of the City of Prichard, Alabama, providing for the enforcement of said regulations, and prescribing senaities for the violation thereof, 3s IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS - FOLLOWS: SECTION 1. Pursuant to the authority granted to the cities and towns of Alabama by Title 37, Section 462 of the Code of Alabama, 1940, as amended, there is hereby adopted by the City Council of the City of Prichard, Alabama, for the purpose of prescribing regulations governing the construction, erection, alteration, or improvement of buildings, the installation of plumbing and plumbing fixtures, the installation of gas and gas fixtures, the installation of electrical wiring and apparatus, and for the sanitary conditions which any habitable occupancy must provide for safe and healthful living, all those certain codes printed in pamphlet forn known as Southern Standard Building Code, 1960-1961 Revision; Southern Standard Building Code, Part II, Gas, 1961-1962 Edition; Southern Standard Building Code, Part III, Plumbing, 1962-1963 Edition; Southern Standard Building Code, Part IV, Housing, 1960-1961 Edition; and National slectrical Code 1962; save and except such portions of said codes, respectively, as are hereinafter deleted, modified, or amended, of which does not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of Prichard and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall take effect, the provisions thereof shall be controlling within the corporate.limits and police jurisdiction of the City of Prichard, Alabama. SECTION 2. The codes hereby adopted are adopted for the purpose of regulating both materials used and the methods of installation, construction, and occupancy. SECTION 3. The codes now hereby adopted are amended and changed in the following respects: A. All sections in the Building, Plumbing, Gas, and Electrical Codes referring to the issuance of permits and schedules of fees for such permits and inspection fees are hereby deleted, B. Permits required by the provisions of Ordinance No. 905 now in effect shall be issued in lieu of any permits required under sections of the Building, Plumbing, Gas, and Electrical Codes deleted by Sectbon 3.-A above. C. Fees for permits and inspection fees shall be in accordance with Ordinances now in effect. D. The Housing Code is amended and changed as follows: (1) Section 306.6 of the Housing Code is deleted in its entirety. SECTION 4. The Electrician II is hereby charged with the enforce ment of the Electrical Code, and the Maintenance Mechanic Inspector is charged with the enforcement of the Building, Plumbing, Gas and Housing Codes. SECTION 5. Penalties, Any person who shall violate any of the provisions of the codes hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, shall be, Page 2 Page -2~ severally, for each and every violation and non-compliance respectively, be guilty of an offense against the City of Prichard, Alabama, and shall be fined not more than One Hundred Dollars and may, in addition to such fine, be sentenced to jail or hard labor for the City of Prichard for a period not to exceed Six (6) months, or by both such fine and imprison- ment. The imposition of one penalty for violation shall not exeuse the violation or permit it to continue. The application of the penalty shall not be held to prevent enforced removal of prohibited conditions, SECTION 6, All former ordinances or Parts of ordinances conflicting or inconsistent with the provisions of this Ordinance or of the codes, or any of them, hereby adopted are hereby repealed, SECTION 7. Should any section, subsection, paragraph, sentence, or word of this ordinance or ef any of the codes hereby adopted be declared for any reason to be invalid, it is the intent of the City Council of the City of Prichard that it would have passed all other portions of this ordinance and the codes,.or any of them, hereby adopted independent of the elimination therefrom of any such portion that May be declared invalid, SECTION 8. This Ordinance and the codes hereby adopted shall take effect and be in force immediately upon its adoption and publication as required by law. ADOPTED this 17th day of February, 1964, APPROVED: . O.
