ORDINANCE No. WZ, /
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY oF PRICHARD,
ALABAMA, AS FOLLOWS:

Section 1. No license shall be issued to any person, firm or
corporation for a beer parlor, beer package store, or other place |
where beer or other malt beverages are to be solid or offered for i
sale unless the following requirements and conditions be complied |
with:
(a) Such parlor, store, or other Place must be more than
four hundred (400) feet by the route usually traveled from any T
other parlor, store, or other place where beer or other malt bev-
erages are sold on the premises.
(b) Such parlor, store, or other Place must not be located
in any zone which is declared residential or in any neighborhood
which is preponderantly residential.
(d) Such parlor, store, or other place must be more than
two hundred ‘fifty (250) yards from any church building or church
grounds or school building or school grounds, but this provision
shall not apply to renewals or licenses now in existence,
(e) Such parlor, store, or other place must provide and
maintain separate sanitary rest rooms for each SOX.
« &(f) Such parlor, store, or other place must have facilities
only for and must serve only persons of either the white or of
the Negro race, and shall not at any time serve, sell or offer
for sale any beer or other malt beverages to members of the Negro
race if such establishment ig licensed for sales to white persons,
and must not at any time, serve, sell, or offer for sale any beer
or other beverages to members of the white race if such estab-
lishment is licensed for Sale to Negroes,

Section 2, If for any reason any portion of this ordinance,
whether section, clause, phrase, words or word, shall be declared
unconstitutional or illegal, such shail have no effect upon the
remaining portions or portion of said ordinance, it being expres-~
sly the intention of the City Council to adopt this ordinance
even though a portion thereof shall be declared invalid.
Section 3, Any person, firm, or corporation violating any pro-
vision of this ordinance shall, upon conviction, be fined not more
than One Hundred ($100.00) Dollars and may in addition, in the dis-
cretion of the Judge or Recorder trying said cause, be sentenced to
jail or hard labor for the City of Brichard for a term not to ex-
ceed six (6) months, one ‘or both,
