Page 1 ORDINANCE NO. _ 1819 AN ORDINANCE TO DIRECT THE STATE OF ALABAMA DEPARTMENT OF REVENUE TO PAY AN AMOUNT CERTAIN OF THE CITY’S UNENCUMBERED GROSS RECEIPTS SALES TAX REVENUE TO FIRST ALABAMA BANK OF MOBILE TOWARDS THE RETIREMENT OF PUBLIC BUILDING AUTHORITY OF THE CITY OF PRICHARD, ALABAMA 6 3/4% PUBLIC OFFICE BUILDING BONDS DATED JUNE 1, 1973 nn SPONSOR: MAYOR JESSE M. NORWOOD WHEREAS, Ordinance of the City of Prichard No. 1024, directed the State of Alabama Department of Revenue to withhold from the City of Prichard’s Gross Receipt Sales Tax the sum of $9,193.33 for direct payment to First Alabama Bank for retirement of that certain bonded indebtedness known as the 1965 Warrant Bond Issue; and WHEREAS, all claims against the 1965 Warrant Bond Issue have been paid and said Bonds have been retired as of May 31, 1995; and WHEREAS, it is the recommendation of the Mayor of the City of Prichard that the sums previously being withheld from the City of Prichard’s Gross Receipt Sales Tax revenue by the Alabama Department of Revenue continue to so be withheld and that payment be directed to First Alabama Bank towards the retirement of the Public Building Authority of the City of Prichard, Alabama 6 3/4% Public Office Building Bonds dated June 1, 1973; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS FOLLOWS: 1. That the State of Alabama Department of Revenue is hereby directed to | withhold from the City of Priehard’s Gross Receipt Sales Tax the sum of Nine Thousand One Hundred Ninety Three and 33/100 ($9,193.33) Dollars and to forward the same to the First Alabama Bank of Mobile, Trust Department, which sum shall represent a partial payment of rent for retirement of outstanding principal and interest on the Public Building Authority of the City of Prichard, Alabama 6 3/4% Public Office Building Bonds dated June 1, 1973. 2. That the State of Alabama Department of Revenue continue to make such withholding and make such payment of funds to the First Alabama Bank of Mobile, Trust Page 2 a Department until otherwise directed by ordinance of the City of Prichard, Alabama. 3. That the sums herein directed to be withheld and paid by the State of Alabama Department of Revenue in Section 2 hereof are hereby appropriated by the City Council of the City of Prichard, pursuant to a recommendation of the Mayor, a copy of which is attached hereto and made a part hereof, and a certification by the Director of Finance of the City of Prichard that said funds are an unappropriated sum sufficient to meet this appropriation pursuant to Section 11-43C-57 Code of Alabama, 1975. 4. That the sums herein appropriated shall be deemed an expenditure in partial satisfaction of line item No. 018686807, Building Authority, of the General Fund Budget of the City of Prichard, Alabama, for Fiscal Year 1994-1995 and for each subsequent general fund budget year hereafter, unless otherwise changed by ordinance duly adopted by the City Council of the City of Prichard, Alabama. 5. The City Clerk of the City of Prichard is hereby directed to forward a certified copy of this Ordinance to the State of Alabama Department of Revenue and to the Trust Department of First Alabama Bank of Mobile. 6. Ordinance No. 1024 is hereby repealed and of no further force or effect. 7. This Ordinance shall be effective immediately upon its adoption and publication as required by Jaw.
