Page 1 ORDINANCE NO.: 1986 7 AN ORDINANCE APPROVING A REDISTRICTING PLAN - FOR THE CITY OF PRICHARD PURSUANT TO SECTION 11-43C-90 OF THE CODE OF ALABAMA 1975 WHEREAS, §11-43C-90 of the Code of Alabama 1975 provides that, “[w]henever there shall be a change in the population in any of the five districts heretofore established following a decennial federal census beginning in 1990, there shall be a reapportionment of the-council districts... ;” WHEREAS, §11-43C-90 provides that the reapportionment plan shall comply with the following specifications: “a, Each district shall be formed of contiguous, and to the extent reasonably possible, compact territory, and its boundary lines shall be the centerlinies of streets or other well-defined boundaries. b. Each district shall contain as nearly as is reasonable the same population. The report shall include a map and description of the districts recommended and shall be drafted as a proposed ordinance and considered by the council as other ordinances are considered. Once filed with the clerk, the report shall be treated as an ordinance introduced by a council member.” ~ WHEREAS, the City of Prichard retained the. services of the South Alabama Regional Planning Commissiori, (“SARPC”), a tri-county a planning agency assisting member governments in Baldwin, Escambia and Mobile Counties in Southwest Alabama with community development and planning; WHEREAS, SARPC presented the governing body of the City of Prichard with proposed plans to redistrict the council districts inthe Gity of Prichard in accordance with the requirements §11-43C-90 and the Voting Civil Rights Act of 1965 as amended and interpreted by courts of competent jurisdiction; WHEREAS, the governing body of the City of Prichard, Alabama conducted public hearings to receive public input over the proposed plans; and WHEREAS, after the close of public opinion and deliberation the governing body of the City of Prichard desires to adopt the plan which most conforms with the dictates of §11-43C-90 andthe Voting Rights Act and laws. -1- Page 2 © : NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, as follows: Section 1. That the governing body hereby adopts the above and foregoing recitations as though fully set out herein. :. Section 2. That pursuant to the provisions of §11-43C-90 of the Code of Alabama 1975 and upon due consideration of and deliberation upon the plans presented for redistricting the city council districts in the City of Prichard, Alabama, the governing body hereby approves and adopts the City Council District Map, Version 2, Revised, as embodied and contained in Exhibit “A” hereto, as the 2011] Redistricting Plan for the Council Districts of the City of Prichard, Alabama. Section 3. That immediately upon the adoption of this Ordinance by the City Council of ~ the City of Prichard and Approval by the Mayor, the City Council staff and/or consultants engaged by the City of Prichard, shall promptly do any and all things necessary and proper to _obtain approval and pre-clearance of the council districts as described in Exhibit “A” by the United States Department of Justice, pursuant to the Voting Rights Act of 1965. Section 4. All previous adopted ordinances in conflict herewith are hereby repealed. - Section 5. This Ordinance shall become effective immediately upon its adoption as O required by law.
