Page 1 ORDINANCE NO. 229 BE IT ORDAINED by the Gity Council of the City of Prichard, Alabama, as follows: SECTION ONE From and after the adoption of this Ordinance it shall be unlawful and an offense against the City of Prichard, Alabama, for any person, firm, association or corporation to cause or allow any mechanical machine capable of reproduction of music, commonly referred to as a juke 5 1 2 1 8 9 1131 840 94 28 91.482536 box, but by whatever named used to be placed or to remain outside a permanent type building or structure. SECTION TWO It shall be unlawful and an offense against the Gity of Prichard, Alabama for any person, firm, association or corpo- ration to cause or allow to remain any Loudspeaker or other system of conveyance of music of any kind on the outside of any permanent type building in the City of Prichard, Alabama. SECTION THREE It shall be unlawful and an offense against the City of Prichard, Alabama for any person, firm, association or corpo- ration to permit or allow, and for any person to engage in dancing of any kind or type outside of permanent type buildings within the City of Prichard, Alabama. SECTION FOUR Any person, firm, association or corporation found guilty Page 2 of violation of this Ordinance shall be fined not more than $100.00 and may, in addition, at the discretion of the Judge or Recorder trying the case, be sentenced to hard labor or jail in the City of Prichard for a term not to exceed six months. SECTION FIVE If any section, provision, sentence, clause or word contained herein shall be found by a Court of competent jurisdiction to be unconstitutional, the remaining portion shall stay in full force and effect, it being the express intention of the City Council of the City of Prichard to enact this Ordinance regardless of such unconstitutionality of any portion thereof, SECTION SIX This Ordinance becomes effective immediately upon its adoption and advertisement as required by Law.
