Page 1 PUBLISH OCT. 25; 1968 ~ ORDINANCE # 3155 AN ORDINANCE INCREASING THE MEMBERSHIP OF THE BOARD OF DIRECTORS OF THE WATER WORKS & SEWER BOARD OF THE CITY OF PRICHARD, ALABAMA, AND ESTABLISHING THE TERMS OF SAID ‘ADDITIONAL MEMBERS a eee WHEREAS, The Water Works Board of the City of Prichard was created pursuant to the authority contained in Title 37, Sections — 394-402, Code of Alabama, 1940, as amended, and its Board of Directors consisting of three members was appointed by the governing body of the City of Prichard pursuant to the provisions of Title 37, Section 397, Code of Alabama, 1940; and WHEREAS, the Certificate of Incorporation of The Water Works Board of the City of Prichard was amended pursuant to the provisions of Act #175, Regular Session of the Legislature of Alabama, 1951, approved July 29, 1951, (Title37, Code of Alabama, Sections 402 (15)- (27)) which said amendment provided among other things, that the name of the corporation would be changed to The Water. c_.Works And Sewer Board of the City of Prichard and further provided, among other things, for the performance of the additional functions by said Board; and WHEREAS, the Legislature of Alabama, andthe Governor of Alakama adopted and appoved Act #113 of the 2nd Special Session of” 1956 (approved April 14, 1956), amending Title 37, Section 397, Code of Alabama, 1940, and providing among other things that such Boards may be increased by the governing body of the City from three to five members; NOW THE REFORE ‘Be it ordained by the City Council of the City of Prichard, Alabama, as follows: SECTION 1: The size of The Water Works and Sewer Board of The City of Prichard, is hereby increased from three (3) to five (5) members. Page 2 =-2— SECTION 2: The term of office of the first such new member . appointed shall be for four years and the term of office of the second such member appointed shall be for the term of six years from the time of the taking of the oath of office. SECTION 3: The members appointed shall comply with all of the provisions of Act #113 of the 2nd Special Session of 1956 (approved April 14, 1956), before entering upontheir duties as directors of The Water Works and Sewer Board of the City of Prichard, and during their continuance as members of said Board. SECTION 4: This ordinance shall become effective upon its adoption by the City Council, ADOPTED by the City Council of the City of Prichard, Alabama, this 21lst day of October , 1968, MAYOR
