Page 1 the, LEGAL NOTICE Ordinance No. 589 WHEREAS, it has become essential to the safety and welfare of the citizens of Prichard that the parking of vehicles be fur- ther regulated on certain portions of certain streats in the City of Prichard hereinafter named; and WHEREAS, parking meters have been duly installed along the property abutting certain portions of the hereinafter named streets in the City of Prichard, Alabama, and individual parking spaces hava been marked off~or otherwise defined adjacent to such meters and, each such parking meter has been so set as to display a@ Signal or other device setting forth the legal parking time conforming to the parking limits set out in Section 2 hereof, upon the deposit in such meter of a coin or coins of the currency of the United States of Amaricay and each of such parking meters has been mechanically prepared to indicate upon the expiration of the said parking‘ limit, by the showing of a proper signal that the lawful parking period for such parking space as fixed by this Ordinance, has expired; NOW,, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS FOLLOWS: : Section 1, The word vehicle, as used in this Ordinance, shall mean any device in, upon, or by which any person or property is or may be transported upon a street or highway, except those operated upon rails or tracks, The words park or parking, when used herein shall mean the parking or standing of a vehicle, whether occupied or attended or not. The words parking 5 1 4 4 6 10 1316 1995 115 32 92.234184 space as used herein shall mean a space or section of the street adjacent to the curbing or other boundary of said street, and indicated by painted or otherwise marked lines extending from such curbing or boundary into tha street adjacent to a parking meter. Section 2. The maximum time limit of parking on the indicated portions of the following named streets shall be as indicated followings Wilson Avenue from Prichard Street to the GM. & 0. Railroad. Page 2 aa wot 2: ° + Main Street from Phillips Streat to Holmes Street. Clark Street from Phillips Street to Holmes Street. Ellis Street from Prichard Street to Clark Street. Max Street from Wilson Avenue to Holmes Street. Phillips Street from Main Street to Clark Street. Section 3. The provisions of the Ordinance shall apply only between the hours of eight o'clock A.M. and six o'clock P.M. on Monday, Tuesday, Wednesday, Thursday, Friday, and Saturday of each week, all times referred to being Central Standard Time, and shall not apply to Sundays or other following enumerated holidays: New Year's Day, Fourth of July, Labor Day, Armistice Day, Thanksgiving Day and Christmas Day of each year. Nor shall this Ordinance apply to vehicles owned or operated by the Police or Fire Departments of the City of Prichard when used imsaconnection with the authorized work of such Departments. Section 4. No parking of vehiclés shall be permitted in front of or across any driveway from the street into the adjacent property or in the street adjacent to the curbing in front of the Police Station or Fire Department, nor within the reserved space adjacent to fire plugs or across sidewalk crossings; and no park- ing of vehicles shall be permitted within spaces reserved by order of the Police Department of the City of Prichard, except that taxi cabs or other public conveyances are not prohibited hereby from occupying places designated for their parking by the City of Prichard. . Secttion 5. A1L vehicles parked on said portions of said streets shall be parked parallel to the curbing, except that on each side of Wilson Avenue the vehicles shall be parked at an angle of thirty-five (35) degrees with the curbing line of such Avenue. It shall be unlawful for any vehicle using the parking spaces established by this Ordinance to park across any of the lines or other marks indicating the boundary of each parking space, and any vehicle using a parking space must be parked wholly within such space. No vehicle parked parallel to the curbing or other boundary of a street shall be at a greater distance than eight (8) inches from said curbing or boundary. Page 3 Section 6. When any vehicle shall be parked-on the streets of tha City of Prichard within any of the designated portions of the streets named in Section 2 of this Ordinance between the hours of eight o'clock AM. and six o"clock P.M., Sundays ;and the herein- above enumerated holidays excepted, the owner, manager or driver of said vehicle shall, immediately upon entering a parking space, deposit the required coin or coins of the United States of America in the, parking neater alongside or next to said parking space and the parking space may then be used by such vehicle during the park- ing limit prescribed by this Ordinance for the portion of the street in which said parking space is located. t shall be unlawe ful for any person to deposit or cause to be deposited in any parking meter any coin or substitute thereof for the purpose of axtending the parking time beyond the time fixed by the Ordinance of the City of Prichard for parking in the parking space alongside of or next to which the said parking meter is placed and it shall ba unlawful for any person to park a vehicle in the area described in Section 2 hereof for,a longer time than that permitted by the provisions of the said Section 2. Section 7. It shall ba unlawful and an offense against the. City of Prichard for any person to permit a vehicle to remain in. any parking space when the parking meter controlling the time Limit of such parking space is displaying a signal making it known that the time limit for legal parking within such space has expired. Section 8. The provisions of the Ordinance shall not apply to vehicles loading or unloading passengers or freight while the loading or wmmloading is being carried on. But no person shall park a. vehicle in a parking space for a period of in excess of two min- utes for the purpose of loading or unloading of passengers. All loading or unloading of freight must ba performed in a continuous and expeditious manner and no vehicle may remain in the parking space for the purpose of loading or unloading freight for a period of time greater than that necessary to continuously and expedi- tiously load or unload such freight, nor while the operator thereof = 4s soliciting or otherwise engaged than in the loading or wnloading = Page 4 of the vehicle, except that a reasonable time shall be allowed for the. signing or securing of receipts or other regular instru- ments connected directly with the loading or unloading. Section 9. It shall be unlawful and an offense against the ~ City of Prichard for any person to, deface, injure, tamper with, open, or wilfully break, destroy or impair the usefulness of any parking meter embraced within the terms of the Ordinance, except those persons duly designated by the City of Prichard to collect the funds so placed in said parking meters, or for the purpose of “ checking such meters or for the purpose of regulating, repairing or removing such parking meters. Section 10. The Chief of Police of the City of Prichard is hereby directed to cause to ba marked on the streets and curbings or other boundaries of said streets the parking spaces herein astablished, and to cause’ them to be re-marked when worn away or obliterated.or when destroyed from any cause whatsoever. Section 11. The City Clerk of the City. of Prichard is hereby directed to collect or to cause to be collected at regular inter- vals during each weak the coins deposited in the cylinders or con tainers in such parking meters. The person or persons removing the coins from the cylinders or containers in such parking meters shall immediately count the coins and make a record of the contents thereof, the recprd to show the date, the numbers of the meters- and the amount of the coins so removed, and such person shall, immedi- ately after making collections, deliver the coins and the record of the collection thereof to the City Clerk. It shall also ba the duty of the City Clerk on the first and fifteenth day of each month, or on the next following day which is not a Sunday or holiday, if such first or fifteenth days be a Sunday or holiday, to cause the meters to be examined for the purpose of determining the number and amount of coins deposited therein during the month and a record thereof shall be kept showing the dates of the examinations, and «the number and amounts of coins registered on the meters. Any person who shall violate any of the provisions of this Ordinance, shall, upon conviction, be deemed guilty of an offense against the City of Prichard, and shall be fined not more than.One Hundred ($100.00) Dollars, and may, in the discretion of the Judge or Recorder trying the cause, be sentenced to jail or hard labor for the City of Prichard for a period of not to excaed six months. Any person who shall aid, abet or assist in the vio-’ lation of any of the provisions of this Ordinance shall, upon con— viction, be punished as though he or she were a principal offender. Section 13. The coins required to be deposited as required herein ara hareby levied as Police Regulation and Inspection fees to cover the cost of installation, regulation, inspection, operation, control and use of the parking spaces and parking meters described herein and to cover the cost involved in checking upon and regu- lating the parking of vehicles in the parking meter spaces created hereby. : ' Section 14+. If any Section, Sub-Section, sentence, clause or portion of this Ordinance is, for any reason, held uconstitutional or invalid, the constitutionality and validity of the remaining por- tions of this Ordinance shall not be thereby affected, it being the expressed intent of the City Council of the City of Prichard, Alabama, in anacting this Ordinance that no portion hereof nor pro- vision nor regulation contained herein shall become inoperative or fail by reason of the unconstitutionality or invalidity of any other portion of said Ordinance. | Section 15.
