Page 1 ORDINANCE NO. #2075 AN ORDNANCE CHANGING THE LOCATION OF POLLING LOCATIONS FOR DISTRICTS TWO AND FIVE FOR MUNICIPAL ELECTIONS IN THE CITY OF PRICHARD, ALABAMA —ee.,_er—_eeoS ee WHEREAS, the council districts in the City of Prichard were previously reapportioned and designated by City Council action pursuant to Ala Code Sec. 11-43C-90 in 2011; WHEREAS, it has been determined that two of the locations established in 2011 no longer provide safe and equal access to voters; WHEREAS, the governing body of the City of Prichard upon due consideration and exigent circumstance has reevaluated the poll locations for District 2 and District 5; WHEREAS, the College Park Baptist Church, upon new ownership, has been rearranged and can no longer safely accommodate the needs of the election process. Further, upon information and belief, it is has been established that it is also unable to observe safe and equal access for voters while maintaining observation of recommended COVID-19 safeguards. Accordingly, an emergency substitution of this polling location is in the best interest and welfare of the citizens of Prichard, Alabama; WHEREAS, upon inspection and prior notice to the administration, the Whistler Fire House no longer provides a safe working environment for poll workers and officials. Due to the current condition of the Fire House, previous recommendations to change the location, and emergent concerns for safety and observation of COVID-19 safeguards, this location no longer provides safe and equal access to voters. Accordingly, an emergency substitution of this polling location is in the best interest and welfare of the citizens of Prichard, Alabama; WHEREAS, the governing body of the City of Prichard desires to adopt and publish the following list of polling locations for municipal elections in the City of Prichard to be held in the year 2020 and thereafter; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS FOLLOWS: Section One. That the governing body of the City of Prichard hereby adopts the above and foregoing recitations by reference as though set forth herein. SectionTwo. That upon due consideration, the governing body of the City of Prichard has determined the foregoing locations as safe physical locations that provide easy and equal access to all voters in the corresponding council districts: Page 2 Section Three. Council District One (1) a. The District One polling location shall be and remain at the listed location: Collins-Rhodes Elementary 5110 Saint Stephens Road Eight Mile, Alabama 36613 Section Four. Council District Two (2) District 2, Box 1 . a. That the District Two polling location, Box 1, shall be and remain at the listed location: Mt. Calvary Baptist Church 505 Mt. Calvary Avenue Prichard, Alabama 36610 4. All duly qualified electors in Council District 2 of the City of Prichard, Alabama residing south of the centerline of North Wasson Avenue in the City of Prichard remain assigned to the polling place designated as District 2, Box 1, located at Mt. Calvary Baptist Church, 505 Mt. Calvary Avenue, Prichard, Alabama, 36610, and shall cast their ballots in any municipal election at said box; and District 2, Box 2 b. The District 2, Box 2, polling place for Council District Two is presently located at the following location: College Park Baptist Church (formerly) 5860 College Parkway Eight Mile, Alabama 36613 is hereby eliminated as the polling place for Council District Two, Box 2 and the same is hereby relocated to: Whistler United Methodist Church 3102 Whistler Street Whistler, Alabama 36612 1. Allduly qualified electors in Council District 2 of the City of Prichard, Alabama residing north of the-centerline of North Wasson Avenue in the City of Prichard are hereby assigned to the polling place designated as District 2, Box 2, located at Whistler United Methodist Church, 3102 Whistler Street, Whistler, Alabama 36612, and shall cast their ballots in any municipal election at said box; and Page 3 Section Five. District Three (3) a. The District Three polling location shall be and remain at the listed location: Vigor High School 913 North Wilson Avenue Prichard, Alabama 36610 Section Six. District Four (4) a. The District Four polling location shall be and remain at the listed location: Sunlight District Auditorium 809 Seminary Street Prichard, Alabama 36610 Section Seven. District 5 a. That the District 5 polling location being presently located at: Whistler Fire Station 3638 W. Main Street Whistler, Alabama 36612 is hereby eliminated as the polling place for Council District Five and the same is hereby relocated to: City of Prichard Senior Citizens Center 2500 West Main Street Prichard, Alabama 36610 Section Eight. That immediately upon the adoption of this Ordinance by the City Council of the City of Prichard and approval by the Mayor, the City Council, and agents or consultants engaged by the City of Prichard, shall promptly do any and all things necessary and proper to obtain approval and pre-clearance of the polling places changes described herein by the United States Department of Justice, pursuant to the Voting Rights Act of 1965. Section Nine. This ordinance shall become effective immediately upon its adoption and publication as required by law.
