Page 1 Ordinance #1889 AN ORDINANCE TO AMEND THE FIRE PREVENTION CODE FOR THE CITY OF PRICHARD, ALABAMA BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, that Ordinance 1763 of the City of Prichard, Alabama adopting the 1991 edition of the Standard Fire Prevention Code and the 1991 National Fire Prevention Codes, is hereby amended as follows: SECTION 1.That the 1997 edition of the Standard Fire Prevention Code, copyright 1997 by the Southern Building Code Congress International, Inc., and the complete set of the 1997 National Fire Codes, published by the National Fire Protection Association, with all amendments and updates thereto, are hereby adopted as the Fire Prevention Code of the City of Prichard. SECTION 2. The said Standard Fire Prevention Code and National Fire Codes shall be kept on file in the Office of the City Clerk of the City of Prichard, Alabama, and available for public inspection. SECTION 3. That a copy of this Ordinance shall be published pursuant to and according to law, after its adoption, but it shall not be necessary for the said Fire Prevention Code and National Fire Codes to be published in a newspaper, nor shall the same be spread at length upon the minutes of the Council, but this Ordinance shall be recorded in the Minutes. SECTION 4. The said Fire Prevention Code and National Fire Codes, 1997 edition with all amendments and updates shall be in full force and effect on and after the __ day of February, 2001, and all ordinances heretofore adopted by the City of Prichard in conflict therewith are hereby repealed. Any person, association, partnership or corporation found guilty of violating any provision of the said Fire Prevention Code and National Fire Codes within the City or its police jurisdiction, shall be prosecuted by municipal ordinance ticket in accordance with the jurisdiction of the Environmental Court Division of the Prichard Municipal Court and shall be fined or punished as set out in the City Code of the City of Prichard, Alabama, SECTION 6. Each days continuance of any activity (or failure to act) prohibited by this ordinance and incorporated Standard Fire Prevention Code and National Fire Codes shall constitute a separate offense. SECTION 7. All City Codes Sections and Ordinances or parts of City Code Sections and Ordinances in conflict with the provisions of this ordinance, are hereby repealed. SECTION 8. If any section, sentence, paragraph, clause, phrase or word of this ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding of invalidity shall not affect the remaining portions of this ordinance, and it shall be construed to have been the intent of the City Council of the City of Prichard to pass this ordinance without such unconstitutional, invalid, or inoperative part therein, and the remainder of this ordinance shall be deemed and held to be valid as if such parts had not been included therein. SECTION 9. This Ordinance shall be in full force and effect from and after its adoption and publication as required by law.
