Page 1 36 Improvement diate > AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS on a part or parts of Cawthon Avenue, North Cawthon Avenue, South Cawthon Avenue, all in the City of Prichard, Alabama; to provide for the kind and character of improvements to be made and the method to be employed in paying for same. BE IT ORDAINED BY THE CITY COUNCIL OF TH& CITY OF PRICHARD, ALABAMA, as follows, to-wit: : CAWTHON AVENUE 1, That Cawthon Avenue be paved from the east edge of the existing pavement on Bay Bridge Road eastward to its intersection with North Cawthon Avenue and South Cawthon Avenue a width of 20 feet throughout, which is to say 10 feet on each side of the center line thereof. NORTH CAWTHON AVENUE 2. That North Cawthon Avenue, be paved from its intersection with Cawthon Avenue and South Cawthon Avenue eastward to the west line of Telegraph Road a width of 20 feet throughout, which is to say 10 feet on each side of the center line thereof. SOUTH CAWTHON AVENUE 3. That South Cawthon Avenue be paved from its intersection with Cawthon Avenue and North Cawthon Avenue eastward to the west line of Telegraph Road a width of 20 feet throughout, which is to say 10 feet on each side of the center line thereof. hs That the aforesaid improvements shall be made in accordance with the established grades provided for in Grade Ordinance No., which said grades together with maps and profiles are to be found in the office of the Consulting Engineer, Ladd Engineering Company, and also such grades, maps and profiles together with Grade Ordinance NO. are on file in the office of the City Clerk, Prichard, Alabama. All such improvements shall comply in full with the detail drawings, maps, profiles, specifications and and surveys as have been submitted by Ladd Engineering Company, Consulting Engineers, and certified and approved by the Council of the City of Prichard, Alabama. 5. That the cost of construction of said improvements shall be assessed against the property abutting on the part or parts of said Avenues, Streets and Alleys so im- proved with the following exceptions: (A) The costs to be assessed shall not exceed $1.00 per foot for lots abutting on pavement 20 feet wide. . (B) The costs of all intersections shall be borne by the City. (C) All costs in excess of the amount hereinabove shall be borne by the City. (D) That no assessment shall exceed the cost of such improvement or the in- creased value of such property by reason of the special benefit derived from such improvements. 6. (A). That the aforesaid pavement shall be plant-mix asphalt surface, constructed on a compacted oyster shell base. . (B). That in the construction of said improvements all necessary culverts, piping, drainage, catch basins and other appurtenances be constructed. Me (A). That the estimated cost of the aforesaid improvements together with the detail drawings, maps, profiles, and specifications prepared by Ladd Engineering Company, C ting Engineers, as already referred to, are on file in the office of the City \ » Prichard, Alabama, and open to inspection by the public. Page 2 ot x (B). That the Council of the Citv of Prichard together with the Mayor will meet at the City Hall on Monday, the 17th day of duly, 1950, at 6:30 P.M. Central Standard Time to hear any objections, remionstrances or protests that may be mide against said improvements, the maner of making ‘the same, the character of materials to be used or the method provided for the payment thereof. . 8. That the Mayor of the City of Prichard, Alabama, is hereby authorised and directed to have this ordinance published in the Prichard Citizen, a weekly newspaper published in said City and in general circulation therein for two consecutive weeks, and he shall , also give notica to each known ower by registered mail whose property is affected by if said improvements, as the law provides in such cases, i This ordinance shall take effect from and after its passage, approval and maze on ig as required by law. , } Passed. and approved this 3rd day of July, 1950. 4 ra G.
