LEGAL NOTICE
ORDINANCE NO. 631
An ordinance defining the term
ore Vendor” and providing
for the regulation and licensing of
the same, the method and manner
of applying for the license, the
fee therefor, and providing a
penalty for the violation of said
ordinance: _ Be it ordained by the
City Council of the City of Prich-
ard, Alabama as follows:
SECTION Ly ITINERANT
VENDOR. The words “Itinerant
Vendor” shall mean and include
all persons, firms, corporations
and associations who seek to do
business in the City of Prichard,
Alabama, or in the police juris-
diction thereof, or who intend to
engage in or conduct therein a
temporary or transient business of
selling goods, wares and merch-
andise for the intent of continuing
in said business in one place for
a period of not more than One
Hundred Eighty (180) days, and
who, for the purpose of carrying
on such business, use, lease or
occupy, either in whole or in part,
a room building or other structure
for the exhibition and/or sale of
goods, wares and merchandise.
SECTION 2. Before any license
shall be issued to any person,
firms corporation or association
coming under the definition of
“Ttinerant Vendor” in Section, 1
hereof, the application shgll be
referred to and reported favorably
by the City Council of the City
of Prichard.
SECTION 3. Each itinerant
vendor, as hereinbefore defined,
shall, after approval of applica-
tion for license, pay to the City
of Prichard a license fee of Fifty
($50.00) Dollars for each month
or fraction thereof that such
itinérant vendor is engaged in
business, and no license shall be
issued for less than a six (6) |
months’ period. |
SECTION 4. Each person, |
pee corporation or association
conducting the business of itin-
/erant vendor shall conspicuously
‘display the City of Prichard
license for such business in a
frame in said place of business
so that the same is plainly visible
to the public.
SECTION 5. Any person, firm,
corporation or association found
guilty of violation of any of the
provisions of this ordinance shall,
upon conviction be fined not less
than One Hundred ($100.00)
Dollars and may, in the discretion
of the Judge or recorder trying |
the cause, be sentenced to hard |
labor or imprisonment in the City |
Jail for a period not to exceed six
(6) months, one or both.
