Page 1 ORDINANCE NO.: AN ORDINANCE TO AMEND ORDINANCE NO. 2055, AS AMENDED BY ORDINANCE NO. __, BEING THE 2017-2018 BUDGET ORDINANCE OF THE CITY OF PRICHARD, ALABAMA WHEREAS, the City Council of the City of Prichard, Alabama approved Ordinance No. 2055 on September 28, 2017, adopting the General Fund Budget for the City of Prichard, Alabama for Fiscal Year 2017-2018, which ordinance was amended by Ordinance No. _ adopted May 31, 2018; WHEREAS, on June 19, 2018 the City Council of the City of Prichard, Alabama met in an Emergency Meeting of the Council called by the President of the Council for the purpose of discussing and considering the emergency removal of raw sewage from Prichard City Hall resulting for the restoration of water service to the city which waste posed an immediate and substantial health risk to employees and members of the general public visiting City Hall; WHEREAS, the Mayor of the City of Prichard has recommended an amendment of the General Fund Budget for the City of Prichard, Alabama for Fiscal Year 2017-2018, as amended, to pay for the expenses incurred in cleaning-up the sewage spill and any plumbing repairs associated therewith as follows, to-wit: (i) That a sum nottoexceed $< is hereby authorized to be expended from the Contingency Fund, operating as a reserve account, which fund presently has on the deposit the sum of $212,942; and (ii) That an account with an appropriate line item be added to the General Fund Budget for the City of Prichard, Alabama for Fiscal Year 2017-2018, as amended, to be known as “2018 City Hall Sewage Spill Clean-up and Repair” shall be added to the expenditure side of said budget into which funds from the Contingency Fund shall be deposited for expenditure in connection with the clean-up. WHEREAS, upon the recommendation of the Mayor of the City of Prichard, the governing body finds and determines that it is in the best interest and good of the City of Prichard to amend Ordinance No. 2055 as requested. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS FOLLOWS: Page 2 Section 1. That on the recommendation of the Mayor of the City of Prichard, Alabama, the following the.governing body of the City of Prichard amends the 2017-2018 General Fund Budget of the City of Prichard are hereby amended, as follows: (a) That a sum not to exceed $ is hereby authorized to be expended from the Contingency Fund, operating as a reserve account, which fund presently has on the deposit the sum of $212,942; and (b) That an account with an appropriate line item be added to the General Fund Budget for the City of Prichard, Alabama for Fiscal Year 2017-2018, as amended, to be known as “2018 City Hall Sewage Spill Clean-up and Repair” shall be added to the expenditure side of said budget into which funds from the Contingency Fund shall be deposited for expenditure in connection with the clean-up. Section 2, That by his signature affixed herein below, the Finance Director of the City of Prichard, Alabama hereby certifies that there is a sufficient unexpended and unencumbered balance in the Contingency Fund, Budget Line to meet the amendments and appropriations contained in Section 1 hereof. Section 3. That all other parts of Ordinance No. 2055, as amended, shall be and remain the same. Section 4. This ordinance shall become effective immediately upon its adoption and publication as required by law. ADOPTED this the day of June, 2018. DERRICK I.
