Page 1 ORDINANCE NO. 939 A, AN ORDINANCE TO PROVIDE FOR CERTAIN STREET IMPROVEMENTS IN THE CITY OF PRICHARD AND TO PROVIDE FOR ASSESSMENT OF THE cost THEREOF AGAINST TRE PROPERTIES SPECIALLY BENEFITSD THEREBY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY oF PRICHARD, ALABAMA AS FOLLOWS: SECTION 1. The streets and portions thereof hereinafter designated shall be paved as hereinafter provided: Warren Street, from center of Bight Street northwestwardly 4936 feet to the center of Center Street. Center Street, from center line of Warren Street southwestwardly 936 feet to the edge of pavement on the Hast side of Culvert Street. Anderson Street, from edge of pavement on south of Culvert Street, southwestwardly 1848.5 feet to edge of pavement on North side of Engine Street. Fifth Street, from edge of pavement on South side of Engine Street southwestwardly 2502.9 feet to edge of pavement on North side of Highway #45. West Seventh Street, from the edge of pavement on South side of Engine Street southwestwardly 1767 ‘feet to center of Malone Street. Thomas Street, from edge of pavement on South side of Whistler Avenue: southwestwardly 2h46 feet to edge of pavement on North side of Engine Street. McGee Street, from edge of pavement on Canada Street southeastwardly 367% feet to center line of Percy Street. College Street, from edge of pavement on West side of Prichard Lane Southeastwardly 263% féet to center of Garrison Street. Rebel Road, from edge of pavement on West side of Gould Street northwestwardly: 2446.65 to dead end. East Seventh Street, from center of Warren Street southwestwardly 975 feet to pavement on North side of Culvert Street. Warren Place, from the center of Warren Street 616.35 feet to the center of Seventh Street. Gould Street, from center of Warren Street southwestwardly 940.7 feet to edge of pavement on North side of Culvert Street. Station Street, from the edge of pavement on West side of Gould Street northwestwardly 23 + 5405 to end of project. SECTION 2. The improvements will consist of the following: Pavement to be single surface treatment with 100# plant mix, 18 feet wide, 8 inch compacted sand and clay base using existing base and inereasing thickness where necessary, existing drainage structures to be used, relocated, extended or replaced where necessary. SECTION 3. That that portion of the cost referred to in Section 1 hereof which shall be borne by the City of Prichard shall be assessed against the properties abutting on the streets and portions thereof herein provided to be improved in the manner provided by the laws of the State of Alabama; provided that no assessment shall exceed the cost of the improvements and no assessment shall exceed the increased value of the property to be assessed by reason of the special benefits derived from such improvenents. SECTION 4. The improvements provided for-in this ordinance shall be completed in accordance with the established grades on file in the office of the City Clerk of the City and with details, drawing, plans, specifications, dnd surveys and cost estimates of said works heretofore prepared by Polyengineering, Inci, Consulting Engineers, and on file in the office of the City dierk of the City of Prichard. The said details, drawing, plans, specifications, and surveys of said work and the cost estimates thereof, which have been exhibited to the City Council, are hereby adopted by said Council and shall remain on file in the office of the City Clerk until March 18, 1963 where affected property owners and others interested may see and examine the samee SECTION 5. The City Council of the City of Prichard will meet on March 18, 1963 at 5300 o'clock P. M. in the city hall to hear any objections, remonstrances, or protests that may be made against the improvemtns provided for herein, the manner of making same, or the character of the materials to be used. SECTION 6. The City Clerk is hereby directed to cause a copy of this ordinance to be published once a week for two suecesive weeks in the The Mobile Press Register, a newspaper published in the city, the first insertion to be at least two weeks prior to March 18, 1963, the date herein set to hear objections, remonstrances, or protests respecting the improvemtns provided for herein. SECTION 7. The City Clerk is hereby directed to have a copy of this ordinance sent by registered mail, postage prepaid to each of the persons last assessing for city taxation the property which may be assessed for said improvements, each such copy to be mailed to each such person at his last known address and to be mailed not less ‘than ten days prior to March 18, 1963.
