Page 1 OC ORDINANCE NO. 1984 __ AN ORDINANCE TO AUTHORIZE CONVEYANCE OF LAND ON WEST DRIVE FROM THE CITY OF PRICHARD TO THE HOUSING AUTHORITY OF THE CITY OF PRICHARD, ALABAMA RECITALS: _ WHEREAS, the City of Prichard has received a.request.from the Housing Authority of ‘the City of Prichard, Alabama, that the City donate the following described lands to the said Housing Authority, to-wit: : Lots 4, 5, 6 & 7, Block 6, Snug Harbor Subdivision, as per plat recorded at Map Book 4, Page 106, of the Probate Court Records of Mobile County, Alabama. Commonly known as West Drive. WHEREAS, said property is not currently used for public or municipal purposes and is not needed for public or mbnicipal purposes. WHEREAS, said conveyance would be a donation for no monetary consideration, but the acquisition and use of the said property by the said Housing Authority would be for the benefit of the general public, be for a public purpose, and would be made to a public housing corporation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA, AS FOLLOWS: Section 1: The Mayor of the City of Prichard is hereby authorized to transfer and convey the following described property to the Housing Authority of the City of Prichard, Alabama, for no monetary consideration at less than fair market value, to-wit: Lots 4, 5, 6 &'7, Block 6, Snug Harbor Subdivision, as per plat recorded at Map Book 4, Page 106, of the Probate Court Records of Mobile County, Alabama. Commonly known as West Drive. Section 2; ° The Mayor of the City of Prichard is authorized to execute, and the City Clerk of the City of Prichard is authorized to attest, such documents as may be reasonably necessary to consummate the conveyance described in Section 1 hereof. Section‘3: The lands described in Section 1 hereof are not currently used for public or municipal purposes and are not needed for public or municipal purposes. _ Section 4: The conveyance and transfer of the lands described in Section 1 hereof to the Housing Authority of the City of Prichard, Alabama, will be for the benefit of the general Page 2 iC) public, be for a public purpose and is being made to a public housing authority of the State of Alabama. Specifically, this property will be used partially for a park to benefit the neighboring community and partially to construct housing which will benefit the City of Prichard by producing tax revenue and a stable and productive neighborhood. Section 5: All City ordinances or part thereof in conflict with the provisions of this ordinance are hereby repealed so far as they conflict. Section 6: If any article, section, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional by a declaration of any court of competent —-Jurisdiction,..such. declaration-shall—not -affect--the: validity of-the remaining -portions~of- this ordinance. .
