ORDINANCE NO, 957
An Ordinance to provide for certain street improvements in the
City of Prichard and to provide for assessing the cost thereof against
the properties especially benefited thereby.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PRICHARD, ALABAMA,
AS FOLLOWS:
SECTION 1, That Grace Avenue be paved from the northeast edge
of Myers Road west to dead end, a distance of approximately 1600
feet, a width of 18 feet throughout, which is to say 9 feet on each
side of the center line thereof.
SECTION 2, That said pavement shall consist of compacted said
elay base, asphalt prime and asphalt plant mix seal. The necessary drain-
age shall be installed.
SECTION 3, The cost of constructing the improvements provided for
in the preceeding Sections 1 and 2 shall be assessed against the properties
abutting on the streets and portions thereof herein provided to be im-
proved in the manner provided by the laws of the State of Alabama;
provided; that no assessment shall exceed the cost of the improvements
and no assessment shall exceed the increased value of the property to be
assessed by reason of the special benefits derived from such improvements.
SECTION 4. The improvements provided for in this ordinance
shall be completed in accordance with the established grades on file
in the office of the City Clerk of the City and with the details,
drawings, plans, specifications, and surveys and cost estimates of
said work heretofore prepared by Polyengineering and on file in the
office of the City Clerk of the City of Prichard. The said details,
drawings, plans, specifications, and surveys of said work and the
cost estimates thereof, which have been exhibited to the City Council,
are hereby adopted by said council and shall remain on file in the
office of the City Clerk until September 9, 1963 where affected property
owners and other interested parties may see and examine the same.
SECTION 5. The City Council of the City of Prichard will meet on
the 9th day of September, 1963 at 5:00 o'clock P. M., in the City Hall
to hear any objections, remonstrances, or protests that may be made
against the improvements provided for herein, the manner of making same,
or the character of the materials to be used,
SECTION 6. The City Clerk is hereby directed to cause a copy of
this ordinance to be published once a week for two successive weeks in
the Mobile Press Register, a newspaper of general circulation in the
City of Prichard, the first insertion to be at least two weeks prior
to September 9, 1963, the date herein set to hear objections, remon-
strances or protests respecting the improvements provided for herein.
SECTION 7. The City Clerk is hereby directed to have a copy
of this ordinance sent by registered mail, postage prepaid, to gach
of the persons last assessing for City Taxation the property which
may be assessed for said improvements, each such copy to be mailed
to each such person at his last known address and to be mailed not
less than ten days prior to September 9, 1963.
Adopted and approved this 29th day of July, 1963.
